LEGAL NOTICE & DISCLAIMER

1. BINDING CONTRACTUAL AGREEMENT

By accessing this website, purchasing original artwork or retail merchandise, or submitting a deposit for custom commissions or murals, you (“the Client”) enter into a legally binding contract with Viasim Studios. If you do not agree to every clause outlined herein, cease all transactions and exit this platform immediately. Ignorance of these terms does not absolve you of your legal and financial obligations under them.

2. STRICT NO-REFUND POLICY

All sales of original artwork, customized paintings, and mural services are final. Deposits are entirely non-refundable and are immediately allocated toward materials, administrative overhead, and calendar reservation. Viasim Studios does not offer "buyer’s remorse" refunds, exchanges, or cancellations outside of the strict windows explicitly detailed in our Business Policies.

3. DISPUTES & CHARGEBACK FRAUD

Viasim Studios enforces a zero-tolerance policy against credit card chargebacks and friendly fraud.

  • Mandatory Direct Resolution: In the event of a dispute, dissatisfaction, or disagreement, the Client is legally required to contact Viasim Studios directly to seek a good-faith resolution before involving a bank, credit card company, or third-party processor.

  • Contesting Chargebacks: Any unauthorized or bad-faith chargeback initiated by a Client will be aggressively contested with full documentation, including IP addresses, signed contracts, email correspondence, and delivery receipts.

  • Financial Liabilities: If you initiate a chargeback and the financial institution decides in favor of Viasim Studios, you will be held fully liable for all administrative damages, collection agency fees, and legal expenses incurred by the studio while defending the claim.

4. COLLECTION & LEGAL REMEDIES

Delinquent accounts, unpaid balances for completed work, or fraudulent chargeback debts will be immediately forwarded to a third-party collection agency and reported to major credit bureaus. Viasim Studios reserves the right to pursue civil litigation to recover unpaid funds. The Client explicitly agrees to pay all attorney fees, court costs, and collection expenses associated with recovering debts owed to the studio.

5. INTELLECTUAL PROPERTY VIOLATIONS

Viasim Studios retains 100% of the copyright to all created works, including commissioned art and murals. The physical purchase of an item does not grant commercial reproduction rights. Any unauthorized duplication, commercial resale, or digital monetization of Viasim Studios’ intellectual property will result in immediate legal action, including cease-and-desist orders and statutory damage claims under federal copyright law.

6. NON-DEFAMATION (ANTI-SLAPP)

The Client agrees that they will not publicly disparage, defame, or publish false, malicious, or misleading reviews regarding Viasim Studios, its owner, or its products on any public forum, social media platform, or review site. Healthy feedback is welcome privately; however, public smear campaigns intended to financially coerce the studio will be met with immediate legal recourse for tortious interference and defamation.
